Water Eject Terms of Service

Welcome to Water Eject: Fix My Speaker! These Terms of Service ("Terms," "Agreement") govern your access to and use of the Water Eject mobile application ("App," "Service," "Water Eject") provided by Water Eject ("we," "us," "our"). By downloading, installing, accessing, or using Water Eject, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By creating an account, accessing, or using Water Eject on Android or iOS devices, you acknowledge that:

• You have read, understood, and agree to be bound by these Terms
• You have read and agree to our Privacy Policy, which is incorporated into these Terms by reference
• You are at least 13 years of age (or the minimum age in your jurisdiction)
• You have the legal capacity to enter into this binding agreement
• If using the App on behalf of an organization, you have authority to bind that organization to these Terms

These Terms apply to all users of the App, including free users.

2. Description of Service

Water Eject: Fix My Speaker is a mobile audio optimization application that provides the following features and services:

• Manual Water Ejection: User-controlled water removal with adjustable parameters
• Speaker Testing: Individual left and right speaker testing and diagnostics
• Microphone Testing: Microphone functionality testing and audio input verification
• Decibel Meter: Real-time audio level monitoring and measurement
• Audio Analysis: Diagnostic information about your device's audio hardware

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice.

3. User Accounts and Registration

3.1 Account Creation

The App may be used with or without account registration. If you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify us of any unauthorized access or security breach. We are not liable for any loss or damage arising from your failure to protect your account information.

3.3 Account Deletion

You may delete your account at any time. Upon account deletion, your account information will be permanently deleted within 30 days.

4. User Responsibilities and Acceptable Use

You may use Water Eject for personal, non-commercial purposes to remove water damage and optimize your mobile device's audio. You agree to use the Service in compliance with all applicable laws and regulations.

4.2 Prohibited Activities

You agree NOT to:

• Use the App for any illegal, fraudulent, or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove, circumvent, or disable any security features or protections
• Use automated systems (bots, scrapers) to access the Service
• Interfere with or disrupt the App's functionality or servers
• Upload malicious code, viruses, or harmful content
• Violate any applicable laws or third-party rights
• Attempt to gain unauthorized access to other users' accounts or data
• Sell, rent, lease, or redistribute the App without authorization
• Create derivative works based on the App
• Use the App in a manner that could damage our reputation

5. Intellectual Property Rights

5.1 Our Intellectual Property

Water Eject, including all content, features, functionality, source code, algorithms, acoustic technology, user interface, graphics, logos, and trademarks, is owned by us and protected by international copyright, trademark, and other intellectual property laws. You acknowledge that:

• The App is licensed to you, not sold
• We retain all rights, title, and interest in the App
• You do not acquire any ownership rights through use of the App
• All trademarks, service marks, and logos are our property

5.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal devices
• Use the App for personal, non-commercial purposes
• Access and use features in accordance with these Terms

This license automatically terminates if you violate these Terms.

6. No Warranty and Disclaimer

6.1 "As Is" Provision

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the App will be error-free, uninterrupted, or secure
• Warranties regarding the accuracy, reliability, or completeness of diagnostic information
• Warranties that defects will be corrected

6.2 Water Removal Results Disclaimer

We do not guarantee that Water Eject will:

• Completely remove water from your device's audio components
• Restore speaker or microphone functionality by any specific percentage
• Prevent permanent damage from water exposure
• Be effective on all device models or water damage scenarios
• Diagnose hardware failures or internal damage

6.3 Device Damage Disclaimer

While Water Eject is designed to safely remove water without damaging your device, we cannot guarantee that using the app will not cause hardware damage. Water-damaged devices are already at risk, and any audio processing may potentially cause additional issues. You use this app at your own risk.

7. Limitation of Liability

7.1 Liability Limitations

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WATER EJECT, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• Indirect, incidental, consequential, punitive, or special damages
• Lost data, revenue, or business opportunities
• Device damage or malfunction
• Failure to restore audio functionality
• Any damages arising from use or inability to use the App

7.2 Maximum Liability

Our total liability to you for any claims arising from your use of Water Eject shall not exceed $100 USD.

8. Indemnification

You agree to indemnify, defend, and hold harmless Water Eject, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws or regulations
• Your negligent or willful misconduct

9. Modifications to Terms and Service

9.1 Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of these Terms
• Notify you through the App or via email for material changes
• Provide reasonable time to review changes before they take effect

Your continued use of Water Eject after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

9.2 Changes to Service

We may modify, suspend, or discontinue any feature of the Service at any time. We are not liable for any modification, suspension, or discontinuation of the Service.

10. Termination

10.1 Termination by You

You may terminate these Terms at any time by:

• Uninstalling the App from your device
• Deleting your account (if applicable)
• Ceasing all use of the Service

10.2 Termination by Us

We may suspend or terminate your access to the App immediately, without prior notice, if you:

• Violate these Terms or our policies
• Engage in fraudulent or illegal activities
• Threaten the security or integrity of the Service
• Violate the rights of other users or third parties

11. Dispute Resolution

11.1 Informal Dispute Resolution

Before filing a claim, you agree to contact us at webbysartaj@gmail.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

11.2 Binding Arbitration

If we cannot resolve a dispute informally, any controversy or claim arising out of or relating to these Terms shall be settled by binding arbitration.

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Water Eject regarding use of the App.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
